Key Aspects of a Sharia-Compliant Will

Fixed Shares of Inheritance: 

Under Islamic law, certain family members—such as spouses, children, parents, and siblings—are entitled to fixed shares of the estate. For example, male heirs typically receive twice the share of female heirs in the same category. These fixed shares are set out in the Quran and must be adhered to in a Sharia-compliant will.

Charitable Giving (Sadaqah or Zakat): 

Islamic law encourages Muslims to give a portion of their wealth to charity, particularly as part of their will. Muslims can choose to leave up to one-third of their estate to non-heirs or charitable causes, provided the remaining two-thirds is distributed according to the fixed shares required by Sharia.

Limitations on Bequests: 

Sharia law allows an individual to make bequests (gifts) to people or causes outside of the family, but this is limited to one-third of the total estate. The remaining two-thirds must be distributed strictly according to the rules of inheritance.

Debt and Funeral Expenses: 

Before any inheritance is distributed, Sharia requires that any debts and funeral expenses are settled first. Only after these obligations have been taken care of can the estate be divided according to Islamic law.
